Terms and Conditions of the MY Crisalix 3D online Community

Prevailing Language. The English language version of these Terms and Conditions shall be controlling in all respects and shall prevail in case of any inconsistencies with translated versions if any.

Please read carefully the following terms and conditions (the "Terms and Conditions of the MY Crisalix 3D online Community") of the online community that Crisalix (as defined below) makes available to you at my.crisalix.com, as they will directly apply to you when you participate or in any way interact on the Crisalix 3D online community (hereinafter, the "MY Crisalix community"). If you do not agree to these MY Crisalix online community Terms and Conditions, please refrain from using, participating, or otherwise interacting on the MY Crisalix community.

Please note that all images, information, and comments that you post on the MY Crisalix community will be freely accessible by all users of that community.

1. Introduction

Crisalix SA with offices at PSE-A, 1015 Lausanne, Switzerland (hereinafter, "Crisalix") offers you the opportunity to participate in the MY Crisalix community as a closed community to interact with other registered users of Crisalix in order to share personal experiences, advice, opinions, ideas, and information about the services provided by Crisalix. The following Terms and Conditions of the MY Crisalix 3D online Community apply to all users who use or in any way participate in the MY Crisalix community.

2. Access to the MY Crisalix community

All use of the MY Crisalix community is subject to these MY Crisalix Terms and Conditions and Crisalix's Privacy policy. By registering as a user on Crisalix, you agree to comply with all applicable legal policies that have been made available to you and to which you have agreed to be bound, generally through the corresponding checkbox. In addition, users of the MY Crisalix community must maintain the confidentiality of all login information and passwords. All registration data must be truthful, complete, and up-to-date.

3. Content generated by users

The Content (as defined below) available through the MY Crisalix community may include information, messages, comments, contact data, surveys, 3D images, profiles, and other materials, each of which is considered "Content." The Content includes, among others, all comments, 3D images, "likes," suggestions, tips, and ideas expressed by a user within the community, as well as information about the services provided by Crisalix. All Content will be permanently available to all users of the MY Crisalix community unless Crisalix considers it necessary or appropriate to restrict access to certain Content under clause 5 infra. All Content is subject to these Terms and Conditions.

4. Participation rules on the MY Crisalix community

With regards to the content that you publish, communicate, or transmit on the MY Crisalix community, you agree to refrain from:

  1. Posting images of third parties or any material owned by third parties such as photos, 3D images, phone numbers, and email addresses;
  2. Exporting or transmitting any content included on the MY Crisalix community outside of it;
  3. Posting materials that are not directly related to the services provided by Crisalix or the MY Crisalix community;
  4. Posting Comments that may be considered abusive, offensive, vulgar, obscene, hateful, racist or intolerant, threatening, defamatory, or fraudulent;
  5. Posting Content or Comments that incite to engage in illegal activities;
  6. Interfering with or interrupting the functioning or integrity of the MY Crisalix community;
  7. Impersonating another person or manipulating content in any other way to hide its origin;
  8. Advertising any business initiative (for example, offering products or services for sale) or otherwise engaging in any commercial activity (for example, conducting raffles or contests, displaying sponsorship banners and/or soliciting goods or services);
  9. Posting files or programs that contain viruses, worms and/or trojans or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer or telecommunications software or hardware;
  10. Posting and including hyperlinks to other websites on the MY Crisalix community.

5. Absence of editorial control or moderation. Disclaimer by Crisalix.

Crisalix does not perform any type of editorial control or moderation in the MY Crisalix community. Crisalix only provides the infrastructure for the MY Crisalix community without contributing any material or content, with users being solely responsible for all content posted in the MY Crisalix community. Consequently, Crisalix assumes no responsibility for comments, publications, content, and/or messages exchanged by users. Likewise, Crisalix is not responsible for the reliability of any source or the accuracy and security of any content.

Notwithstanding the foregoing, Crisalix reserves the right to remove and modify any content at any time, with or without prior notice, if it considers that it infringes these Terms and Conditions of MY Crisalix or its Privacy policy. Crisalix has the authority to block users who violate these Terms and Conditions of MY Crisalix from posting on their profile or to directly cancel the user's account. In addition, Crisalix also reserves the right to communicate content to judicial authorities or competent administrative entities when necessary to comply with applicable legal regulations or at the request of such authorities.

Users can block any other user and report abusive use in MY Crisalix through the "Report User" functionality.

6. Cookies policy

We use our own and third-party cookies so as to allow for more functional and useful browsing on the Community. In this regard and with the aim of ensuring that you receive all of the necessary information for correct browsing, we provide you with the following informative text about what cookies are, and the type of cookies used:

6.1. What is a cookie?

A cookie is a small text file that websites install in the computer or mobile device of the users who visit them.

These cookies, which are processed either by Crisalix or by third parties, help to quantify the number of users and, therefore, they carry out measurements and statistical analysis of the use made by users of the offered service. Thus, your browsing on the community is analysed with the aim of improving the provision of the products or services we offer. We may use this information to understand and analyse trends, to administer the site, to learn about user behaviour on the site, and to gather demographic information about our user base as a whole. Crisalix may use this information in our marketing and advertising services, and for statistical purposes. Besides, in some of our email messages, we may use a “click-through URL” linked to content on the Crisalix website or elsewhere. When users click one of these URLs, they may pass through a separate web server before arriving at the destination page. We track this click-through data to help us determine effectiveness of our customer communications. If you prefer not to be tracked in this way, you should not click text or graphic links in the email messages. Pixel tags enable us to send email messages in a format customers can read, and they tell us whether mail has been opened. We may use this information to reduce or eliminate messages sent to customers.

6.3. Cookies consent

By continuing to use the MY Crisalix community and accepting these terms and conditions, you explicitly consent to and accept the usage of the cookies as described above.
